Warning: Mountain cart riding is a sport and recreational activity that carries an increased risk of accidents and injuries. Participation requires prudent, responsible driving behavior that is appropriate to one’s own abilities.
By accepting the mountain cart, the user confirms that they have read, understood, and accepted these Terms of Use.

1. Participation Requirements
Only individuals who are at least 10 years old and at least 140 cm tall are permitted to use a Mountaincart. Children and adolescents under the age of 14 may use the track only when accompanied by an adult supervisor.
The maximum weight limit is 120 kg per person.
Carrying additional passengers on the Mountaincart is not permitted. In particular, children may not be carried on a lap or in any other manner.

2. Safety Equipment and Briefing
Helmets must be worn at all times during the ride. Sturdy, closed-toe shoes must also be worn.
Before the ride begins, you must complete the mandatory safety briefing provided by the staff. Use of the Mountaincarts is permitted only after the briefing has been completed.

3. Pre-ride Inspection
Each user is required to inspect the brakes and the general condition of the Mountaincart for obvious defects before riding.
Any defects or malfunctions discovered must be reported to staff immediately. Mountaincarts with visible defects must not be used.

4. Conduct on the Track
Mountaincarts may only be used on the designated and approved track. Leaving the track or driving in restricted areas is prohibited.
Speed must always be adjusted to track conditions, visibility, and your own abilities. Overtaking is not permitted.
Always use both brakes simultaneously when braking.
While driving, maintain a sufficient safety distance from the mountain cart ahead. This distance must be at least 20 meters.
Stopping on the course is permitted only in exceptional cases and for as short a time as possible. When stopping, do so at the right-hand edge of the course and exclusively in clearly visible locations. Stopping behind curves, over hills, or at other blind spots is prohibited.
On the course, you must be prepared at all times for pedestrians, vehicles, agricultural traffic, livestock, or other obstacles. Wild animals and other animals must not be chased, startled, or disturbed.
You must strictly follow the instructions of the staff and the signage along the course. In the event of violations of the terms of use or the staff’s instructions, use of the Mountaincart may be prohibited or terminated without entitlement to a refund of the rental fee.

5. Health Requirements
Use of the Mountaincarts is not permitted for persons who,

• during pregnancy,
• for cardiovascular diseases,
• spinal or back problems,
• in the case of other health conditions that could be exacerbated by driving,
• as well as while under the influence of alcohol, drugs, or medications that may impair reaction time or the ability to drive.

Each user is responsible for assessing their own medical fitness to participate.

6. Denial of Access to
Staff are authorized to deny access to individuals if there are safety concerns or doubts regarding their physical, mental, or health-related fitness. This applies in particular in cases of visible intoxication, impairment due to drugs, inappropriate behavior, or violation of the Terms of Use.

7. User Liability
The user is liable for any damage to the Mountaincart, helmet, or other issued equipment caused by improper use, negligence, failure to comply with these Terms of Use, or intentional conduct.
This includes, in particular, repair, replacement, material, and consequential costs.
The user is liable for the full amount of damage incurred in the event of loss of the Mountaincart, helmet, or other rented equipment.
The user is also liable for damages caused to third parties or their property.

8. Reporting Accidents and Damage
Accidents, falls, collisions, and damage to the Mountaincart or other equipment must be reported to staff immediately.

9. Liability of the Operator
Use of the Mountaincarts is at your own risk.
The operator is liable exclusively within the scope of statutory provisions for damages resulting from intentional or grossly negligent conduct on the part of the operator or its agents.
Liability for damages resulting from the user’s own fault, failure to comply with these Terms of Use, misconduct by other persons, weather conditions, natural events, or the condition of the track is excluded to the extent permitted by law.
The operator assumes no liability for the loss, theft, or damage of personal belongings.

10. Suspension of Operations and Route Closures
The operator is entitled to restrict, interrupt, or suspend operations at any time due to adverse weather conditions, technical malfunctions, official orders, or other safety reasons.

11. Rescue and Recovery Costs
To the extent permitted by law, costs forrescue, search, or recovery operations caused by the user’s intentional or grossly negligent conduct may be billed to the user.
